Monaco Government Proposes Law to Introduce Amicable Termination for Employees
Legislation aims to reform employment law by integrating the concept of 'rupture conventionnelle' into Monaco's labor code.
On April 30, 2025, the government of Monaco submitted a legislative proposal to the National Council that seeks to amend the labor code, introducing significant changes for both private and public sector employees.
The proposed bill comprises 16 articles and outlines the intention to formalize the concept of 'rupture conventionnelle,' a mechanism that will allow employees to leave their positions while retaining specific benefits, including financial compensation.
This legal framework, which has existed in France for several decades, facilitates amicable resignations between employers and employees.
According to the bill, the amount of the termination indemnity will be 'mutually agreed upon by the parties, subject to certain conditions related to the employee's length of service.' The National Council is expected to deliberate and possibly vote on this legislation in the autumn of 2025.
